TERMS AND CONDITIONS

I. General Provisions

  1. These terms and conditions set out the rules for the sale of products by Little Cloud, with its registered office at 4567 Tulip Street, 3011 WD Rotterdam, Netherlands.

  3. These terms and conditions also define the rights and obligations of Buyers and the Seller, in accordance with the applicable laws of the European Union, particularly the Consumer Rights Directive (2011/83/EU), the General Data Protection Regulation (GDPR), and regulations concerning distance selling.

II. Definitions

  1. Seller – Little Cloud, a company with its registered office in Rotterdam.
  2. Buyer – any natural person, legal entity, or organizational unit that purchases products from the Seller.
  3. Terms and Conditions – this document setting out the rules for the sale of products by Little Cloud.
  4. Consumer – a natural person who is purchasing goods for purposes not directly related to their business or professional activity.

III. Ordering Conditions

  1. Orders can be placed via the online store available at little-cloud.eu.
  2. Orders can be placed 24 hours a day, 7 days a week.
  3. The Buyer is required to provide accurate contact and address details.
  4. By placing an order, the Buyer accepts the terms and conditions.

IV. Conclusion of the Contract

  1. The sales contract is concluded at the moment the order is confirmed by the Seller.
  2. The Seller confirms the order electronically to the email address provided by the Buyer.
  3. The Seller reserves the right to refuse to process an order without giving a reason.
  4. If the ordered product is unavailable, the Seller will promptly inform the Buyer and refund any payments received.

V. Prices and Payments

  1. All product prices are quoted in PLN and include VAT.
  2. The Buyer may pay for the order using the following methods:
    • bank transfer to the Seller’s account,
    • credit or debit card,
    • through electronic payment systems.
  3. The Seller reserves the right to change product prices in the online store. These changes do not affect orders that have already been placed.
  4. When paying by credit or debit card, the Buyer confirms that they are the authorized holder of the payment card used.

VI. Delivery

  1. Orders are fulfilled within the European Union.
  2. The Buyer bears the delivery costs, which depend on the chosen method of delivery.
  3. The delivery time is 3 to 10 working days from the moment the payment is credited to the Seller’s account.
  4. The Seller is not responsible for delays in delivery caused by courier companies.
  5. The risk of damage or loss of goods passes to the Buyer upon delivery to the carrier.

VII. Right of Withdrawal and Returns

  1. The Buyer, as a Consumer, has the right to withdraw from the contract within 14 days from the date of receiving the order without giving any reason, in accordance with Directive 2011/83/EU.
  2. To withdraw from the contract, the Buyer must inform the Seller of their decision by email at [email protected].
  3. The returned goods must be in their original condition, in the original packaging, and accompanied by proof of purchase.
  4. The Buyer bears the cost of returning the goods.
  5. A refund will be issued within 14 days from the date the returned goods are received by the Seller.
  6. The Buyer is responsible for any reduction in the value of the goods resulting from handling the goods beyond what is necessary to establish their nature, characteristics, and functioning.

VIII. Complaints

  1. The Buyer has the right to lodge complaints about purchased products that have manufacturing defects.
  2. Complaints should be submitted by email to [email protected].
  3. The Seller will consider the complaint within 14 days of its submission.
  4. If the complaint is accepted, the Seller will replace the product with a new one or refund the payment.
  5. Complaints regarding damage incurred during transport will only be considered if the Buyer reports the damage to the carrier at the time of delivery.

IX. Data Protection

  1. The Seller processes the personal data of Buyers in accordance with the applicable data protection laws, including the GDPR (Regulation (EU) 2016/679 of the European Parliament and of the Council).
  2. Buyers’ personal data is used solely for the purpose of fulfilling orders and for marketing purposes, provided that the Buyer has given their consent.
  3. The Buyer has the right to access their personal data, correct it, request its deletion, and object to its processing.
  4. The Seller does not share Buyers’ personal data with third parties, except when necessary for the fulfillment of the order (e.g., sharing data with the carrier) or when required by law.

X. Final Provisions

  1. These terms and conditions are effective from the date of their publication on the Seller’s website.
  2. The Seller reserves the right to change the terms and conditions without prior notice, but such changes do not affect rights acquired by the Buyers before the changes were implemented.
  3. In matters not regulated by these terms and conditions, the laws of the country to which the shipment is made shall apply, and in terms of consumer protection, the laws of the European Union shall apply.
  4. Any disputes arising in connection with the performance of sales contracts shall be settled by the competent courts for the Seller’s registered office, except for disputes with Consumers, where the jurisdiction of the courts is determined based on applicable consumer protection laws.
